Pursuant to the provision of Article 75 ,section 4 of Afghanistan Constitution
and on the basis of draft number 20 dated 17/07/2008 of Ministers’ meeting, the
Public Procurement Law was enacted by Decree number 59 dated 21/07/2008 of H.E.
President of Islamic Republic of Afghanistan and on 29/07/2008 was promulgated
in Gazette to regulate both domestic and foreign procurement of goods, works and
services for administrations, institutions and mixed companies. Based on draft
number 47 dated 17/01/2009 of Ministers’ meeting and Decree number 146 dated
18/01/2009 of H.E. President of Islamic Republic of Afghanistan, amendments were
incorporated to this law.
This law is executable from the date promulgated in the official gazette and by
execution of this law, the law promulgated in gazette 565 dated 25/10/2005 and
all other provisions that conflict with this law, are nullified.
The purposes of this Law are:

ensuring transparency in procurement
proceedings;

[to have] effective control of financial
affairs and public expenditure;
-
ensuring economy [best value for money]
in the procurement of goods, works and services;
-
Providing tendering opportunities for
participation to all eligible bidders in procurement proceedings.
